Insurance claim procedure

I. Filing of a claim. Insurance claims can be divided into the following two categories:

1. If the export goods suffer losses, the other party (the importer) shall file a claim application with the foreign claim settlement agent specified in the insurance policy. The People's Insurance Company of China in the major ports and cities in the world, have entrusted foreign inspection agents and claims agents two kinds of institutions, the former is responsible for the inspection of cargo losses. After the consignee obtains the inspection report, attached with other documents, it can claim from the issuing company on its own, and the latter can directly handle the claim within a certain amount of authorization and pay the compensation on the spot.


The importer shall provide the following documents at the same time when making a claim to our foreign claims agent:


(1) Original insurance policy or certificate of insurance;


(2) Contract of carriage;


(3) Invoice;


(4) Packing list;


(5) Letters or other documents requesting compensation from the third party responsible party such as the carrier, as well as documents proving that the insured has fulfilled the required recovery procedures;


(6) Inspection report issued by a foreign insurance agent or a foreign third party notarial institution;


(7) Maritime report. In general, the insurance company shall pay for the loss of goods caused by maritime affairs, and the ship shall not be liable.


(8) Proof of damaged goods;


(9) a list of claims; Let's wait.


2. If the imported goods suffer losses, the Chinese importer shall file a claim application with the insurance company. When the imported goods are found to be damaged or short after arriving at our port, airport or mainland, the local insurance company shall be notified immediately and the local national commodity inspection department shall jointly inspect them. If it is determined that the loss falls within the scope of insurance, the local insurance company shall issue the Inspection Report of Imported Goods. At the same time, the insurance company will pay compensation for any cargo damage accident involving a foreign shipper, carrier, port authority, railway or other third party, as long as the consignee completes the procedures for recovery from the above-mentioned responsible parties. However, for the relevant quality and specification liability problems belonging to foreign shippers, according to the provisions of the insurance company, the insurance company is not liable for compensation, and the consignee should ask the national commodity inspection authority to issue a notarial inspection certificate, and then the receiving unit through the foreign trade company to lodge a claim to the shipper.


The consignee of imported goods shall submit the following documents when making a claim to the insurance company:


(1) Import invoice;


(2) Bill of lading or import and export goods arrival notice, waybill;


(3) Record of discharge at final destination and weight list.


If the shipper is responsible for the loss, an order contract must be provided. Shipper's letter of guarantee and ship's endorsement, if any, should also be provided. If the loss involves the liability of the ship, a port of discharge tally visa shall be provided. Ship's annotations, if any, will also be provided. Where the responsibility of the consignor or the ship is involved, it needs to be identified by the State commodity inspection department. If the loss involves port handling and the liability of the inland, inland or rail carrier, the freight record (business record) and joint inspection report issued by the responsible party shall be provided.


The consignee may claim from the insurance company in the following ways: for the loss of the goods imported by sea, claim from the insurance company at the port of discharge; Claim for loss of goods imported by air to the insurance company of destination indicated on the international waybill; Claim against the insurance company of destination indicated on the international parcel list for the loss of imported goods by post; Claims for losses of imported goods transported by land shall be made to the insurance company at the destination indicated on the international railway waybill.


2. Examine the liability and pay compensation. After completing the above-mentioned claim procedures and providing complete documents, the insured can wait for the insurance company to verify the liability and pay the compensation. In China, insurance companies have two ways of compensation: one is to pay directly to the receiving unit; The second is to concentrate the compensation to the relevant foreign trade companies, and then the foreign trade companies and the ordering units to settle.
